Dog Bite Liability in California
Who can be held responsible when a dog bites someone in California?
Dog Owner Liability
Under California's strict liability statute (Civil Code §3342), the dog owner is the primary party responsible for a dog bite. The owner is liable regardless of whether they knew the dog was dangerous or whether the dog had ever bitten before.
This applies whether the bite occurs in a public place or on private property (as long as the victim was there lawfully).
Landlord Liability
In certain circumstances, landlords can be held liable for dog bites that occur on their rental property. A landlord may be liable if:
- • They knew the tenant's dog was dangerous
- • They had the ability to remove the dog or the tenant
- • They failed to take reasonable action
Property Manager Liability
Property managers and HOAs may also be liable if they knew about a dangerous dog on the property and failed to act. This can include common areas in apartment complexes, condominiums, and planned communities.
Dog Keeper / Handler Liability
Even someone who isn't the dog's owner but was responsible for the dog at the time of the bite (a dog walker, pet sitter, or kennel operator) may be held liable under a negligence theory. This applies when the handler fails to exercise reasonable care in controlling the dog.
Insurance Coverage
Most dog bite claims are paid through homeowner's or renter's insurance policies. The typical homeowner's policy covers dog bite liability up to $100,000–$300,000. Some policies exclude certain breeds or dogs with a bite history.
If the dog owner doesn't have insurance or their coverage is insufficient, you may still be able to recover compensation directly from the owner's personal assets.
